Up to 75% of Cleanup Costs Reimbursed Through a Brownfield Redevelopment Agreement


One of the provisions of the 1998 Brownfield and Contaminated Site Remediation Act (N.J.S.A. 58:10B-1 et seq.) is the establishment of the Brownfield Redevelopment Agreement program. Jointly managed by the NJ Economic Development Authority (EDA), NJ Department of Treasury, and the NJ Department of Environmental Protection (DEP), the program enables a third-party purchaser and/or redeveloper to obtain up to 75% of the costs associated with investigation and remediation of contaminated and under-utilized commercial and/or industrial properties referred to as "Brownfields". Reimbursement monies are from new State taxes generated by redevelopment of the site, including sales, corporate, and hotel among others.
