On May 7, 2009, the Site Remediation Reform Act (SRRA), P.L. 2009, c.
60, was signed into law by Governor Jon Corzine bringing sweeping changes
to the environmental compliance process in New Jersey. Under the new law,
qualified Licensed Site Remediation Professionals (LSRPs) will be responsible
for conducting the remediation at many sites from start to finish. The
work must be conducted in accordance with New Jersey Department of Environmental
Protection (NJDEP) regulations and technical guidance but, for projects
that qualify, prior NJDEP review and approval will not be required thus
enabling the LSRP to guide the project through the remediation process
in a significantly shorter timeframe.
Upon completion, the LSRP will certify the work and issue a Response
Action Outcome (RAO) which, under SRRA, is equivalent to a No Further
Action (NFA) letter issued by the NJDEP.

of the environmental compliance process from Preliminary Assessment through
Site/Remedial Investigation, evaluation of Remedial Action Alternatives
and Cost Benefit Analyses, Remedial Action Design, Remedial Action Implementation,

LSRP Program
- Effective November 3, 2009, a temporary LSRP licensing program goes
into effect which will be followed in three years by a Permanent LSRP
license after successful completion of a qualifying exam being developed
by the NJDEP.
- EXCEL has multiple highly trained and experienced environmental consulting
and engineering staff members that qualify for the Temporary LSRP program.
- Upon issuance of the temporary licenses (anticipated in November 2009),
EXCEL will immediately start working with clients who are either transitioning
their existing investigation and remediation project(s) from NJDEP case
management to an EXCEL LSRP or initiating a new project with an EXCEL
LSRP leading the way.
SRRA Project Reviews
- There are many other modifications to the environmental compliance
process in New Jersey, including for example LSRP issuance of RAOs,
mandatory timelines, presumptive remedies for certain situations, NJDEP
oversight and project review triggers, and NJDEP audits, along with
new technical guidance and protocols currently being developed by NJDEP.
